Solariq360 Inspection Report Disclaimer

This Inspection Report Disclaimer applies to all solar inspection reports, consultations, evaluations, summaries, observations, and related materials prepared by Solariq360 (“Solariq360,” “we,” “us,” or “our”).
By requesting, receiving, reviewing, or relying on any report or related service provided by Solariq360, you acknowledge and agree to the following terms.
1. Purpose of Report
Any inspection report issued by Solariq360 is intended solely to provide a limited, non-invasive, observational assessment of the solar energy system and related visible components as they appeared at the time of the inspection.
Inspection reports are intended to assist the client in understanding the general observed condition of a solar system based on the scope of services ordered. They are not a warranty, insurance policy, guarantee, certification, or prediction of future performance.
2. Limited Scope
Unless otherwise specifically stated in a separate written agreement, Solariq360’s inspection services are limited in scope.
Reports may be based on some or all of the following, depending on access and the service ordered:

visual observation of accessible solar components
-
review of visible panels, inverter(s), disconnects, mounting hardware, and related components
-
limited review of monitoring data, if available
-
review of documents provided by the client, property owner, agent, installer, or third party at time of inspection
-
general observations regarding apparent condition, installation characteristics, or system concerns
Inspection services generally do not include, unless expressly stated in writing:

destructive testing
-
concealed condition discovery
-
opening sealed equipment
-
dismantling components
-
roof engineering analysis
-
electrical engineering analysis
-
code compliance certification
-
permit verification
-
title or ownership verification
-
legal interpretation of agreements or warranties
-
internal equipment diagnostics
-
laboratory testing
-
thermal imaging, unless specifically included
-
guaranteed production verification
-
utility billing analysis beyond the documents provided
-
future performance forecasting as a guarantee
3. Conditions Are Reported as Observed on Inspection Date
Any findings, opinions, or conclusions in a Solariq360 report reflect conditions only as they existed on the date and time of the inspection, based on the level of access available.
Solar systems and properties may change at any time due to:

weather
-
age
-
use
-
deferred maintenance
-
equipment failure
-
inverter shutdown
-
roof movement
-
electrical issues
-
service modifications
-
undocumented repairs
-
utility interruptions
-
software or monitoring issues
Solariq360 has no responsibility to update a report after issuance unless engaged separately in writing.
4. No Guarantee of Performance, Output, Savings, or Remaining Life
Solariq360 does not guarantee:

present or future system performance
-
energy production
-
utility savings
-
incentive eligibility
-
payback period
-
equipment lifespan
-
remaining useful life
-
absence of defects
-
compliance with manufacturer specifications
-
continued operability of any component
Any estimate, projection, or comment regarding performance is informational only and should not be interpreted as a guarantee.
5. No Warranty or Insurance
A Solariq360 inspection report is not a warranty, service contract, insurance policy, or guarantee of any kind.
Solariq360 disclaims all express and implied warranties, including any implied warranties of merchantability, fitness for a particular purpose, habitability, code compliance, or future operability.
6. Accessibility Limitations
Inspection findings are limited by site conditions and access constraints. Solariq360 is not responsible for conditions that were:

hidden
-
obstructed
-
inaccessible
-
unsafe to inspect
-
not disclosed by the client or third parties
-
outside the agreed inspection scope
This includes, without limitation:

concealed wiring
-
hidden roof penetrations
-
inaccessible attic or roof areas
-
locked electrical panels
-
inactive monitoring platforms
-
unavailable production records
-
unavailable permits or contracts
-
undocumented modifications
7. Client Responsibilities
The client is responsible for:
-
ensuring lawful access to the property and solar system – the requesting party declares it is authorized to provide access or will provide the name of the party authorized to do so, at time of inspection
-
providing accurate and complete information
-
supplying requested documents where applicable
-
reviewing the report in full
-
obtaining specialist review where recommended
If Solariq360 recommends review by a licensed electrician, roofer, solar contractor, structural engineer, attorney, tax advisor, or other specialist, the client is solely responsible for obtaining that further review.
8. Not a Substitute for Specialist Evaluation
A Solariq360 report is not a substitute for evaluation by other licensed or qualified professionals where needed.
Depending on the circumstances, the client may need separate review by:

a licensed electrician
-
a licensed roofing contractor
-
a structural engineer
-
a solar installer or repair contractor
-
a legal professional
-
a tax professional
-
a utility or financing representative
-
equipment manufacturers or warranty administrators
9. Real Estate Transaction Limitation
If the inspection is performed in connection with a real estate transaction, the report is prepared solely for the client who engaged Solariq360.
No third party, including but not limited to:
-
buyers
-
sellers
-
brokers
-
agents
-
lenders
-
escrow companies
-
insurers
-
contractors
-
tenants
-
subsequent property owners
may rely on the report without Solariq360’s prior written consent.
Any unauthorized reliance is expressly prohibited and at the relying party’s sole risk.
10. Document Review Limitation
If Solariq360 reviews installation agreements, warranties, proposals, utility statements, monitoring screenshots, transfer documents, or other paperwork, such review is limited to general observational and operational context unless Solariq360 expressly agrees in writing to provide legal or specialized analysis.
Solariq360 does not provide legal advice and does not guarantee the enforceability, completeness, accuracy, transferability, or legal effect of any third-party document.
11. Photographs and Supporting Media
Photographs, screenshots, or attachments included with a report are provided as illustrative support only. They may not depict every condition present at the property or every component reviewed.
Absence of a photograph does not mean absence of a condition, and inclusion of a photograph does not necessarily indicate severity, priority, or completeness of the issue shown.
12. Recommendations Are Advisory Only
Any recommendations, comments, summaries, or next-step suggestions are advisory only. The client is solely responsible for determining what actions to take based on the report and for obtaining further inspection, repair, replacement, legal review, or contractor bids as needed.
13. No Code or Permit Certification
Unless expressly stated in writing, Solariq360 does not certify that any solar system:
-
complies with local, state, or federal codes
-
was properly permitted
-
passed final inspection
-
meets utility interconnection requirements
-
qualifies for rebates, tax credits, or incentive programs
14. Limitation of Liability
To the fullest extent permitted by law, Solariq360’s total liability arising from or related to any inspection, report, consultation, or related service shall be limited to the amount actually paid to Solariq360 for the specific service giving rise to the claim.
Solariq360 reserves the right to de-energize any system deemed unsafe at time of inspection. Any party can re-energize the system at their own discretion and liability, post inspection.
Under no circumstances shall Solariq360 be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to:

loss of use
-
loss of production
-
loss of income
-
loss of energy savings
-
lost profits
-
diminution in property value
-
repair costs
-
replacement costs
-
transaction losses
-
financing losses
-
missed deadlines
-
consequential real estate damages
15. Reliance and Use Restriction
The report is intended only for the client and only for its intended purpose. Reports may not be reused, redistributed, republished, assigned, or relied upon for other transactions, properties, or dates without Solariq360’s written authorization.
16. No Ongoing Duty
Solariq360 has no ongoing duty to monitor the solar system, update findings, notify any party of changing conditions, or revisit the property unless retained separately in writing.
17. Acceptance
Use of Solariq360’s inspection services, receipt of a report, or payment for services constitutes acceptance of this Inspection Report Disclaimer and any related service agreement or terms of service.
