Solariq360 Terms of Service

IMPORTANT NOTICE – DISPUTE RESOLUTION & ARBITRATION

The section below titled “Dispute Resolution & Arbitration” requires you to resolve disputes with Solariq360 through binding arbitration instead of court proceedings. It also includes a class action waiver. This provision affects your legal rights. Please read it carefully.


1. Acceptance of Terms

Welcome to Solariq360.

These Terms of Service (“Terms”) constitute a legally binding agreement between you and Solariq360 (“Solariq360,” “we,” “our,” or “us”) regarding your use of:

  • the Solariq360 website(s)

  • online tools and digital platforms

  • any mobile or web-based applications

  • and any services offered through these platforms

(collectively referred to as the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Service.


2. Modifications to These Terms

We may update or modify these Terms at any time.

When changes are made:

  • the updated Terms will be posted on this page

  • the “Last Updated” date will be revised

Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.


3. Description of Services

Solariq360 provides solar energy consulting and inspection services, including but not limited to:

  • solar system inspections

  • solar system performance assessments

  • solar documentation review

  • solar condition reports

  • consulting services for homeowners, real estate professionals, and property owners

  • advisory services related to solar system ownership, maintenance, and system performance

Solariq360 may also provide referrals to third-party solar service providers, including installers, maintenance providers, or equipment vendors.

Solariq360 does not manufacture solar equipment and generally does not install or repair solar systems directly unless otherwise expressly stated in a separate agreement.

Information provided through the Service is for informational and advisory purposes only and should not be relied upon as a guarantee of solar system performance.


4. Eligibility

You must be at least 18 years of age to use the Service.

By using the Service, you represent and warrant that:

  • you are at least 18 years old

  • you have the legal capacity to enter into this agreement

  • any information you provide is accurate and complete

The Service is not intended for individuals under the age of 18.


5. Payments

If you purchase services through Solariq360, you agree to pay all applicable fees.

By submitting payment information, you authorize Solariq360 or its payment processor to charge your selected payment method for:

  • service fees

  • applicable taxes

  • any additional authorized charges

Payments may be processed through third-party payment providers.

If recurring payments apply to your service, you authorize Solariq360 to charge your payment method automatically until canceled.

To cancel recurring payments, you must notify us at least 7 days prior to the next billing cycle.

Unless otherwise stated in a written agreement:

All service payments are final and non-refundable.


6. Promotions and Offers

Solariq360 may occasionally provide promotional offers, discounts, or marketing promotions.

Promotions:

  • may expire at any time

  • may be modified without notice

  • may be provided by third parties

Solariq360 does not guarantee the availability or validity of third-party promotions.


7. Data and System Information

Some services may provide access to solar system information, including:

  • energy production estimates

  • system performance data

  • inspection findings

  • projected system performance

This information (“Data”) is provided for informational purposes only.

Solariq360:

  • does not guarantee the accuracy of Data

  • does not guarantee system performance

  • is not responsible for decisions made based on the Data

Solar system performance depends on many factors including equipment condition, weather, maintenance, and installation quality.


8. Acceptable Use

You agree not to:

  • use the Service for unlawful purposes

  • access the Service using automated tools such as bots or scrapers

  • interfere with or disrupt the Service

  • attempt to gain unauthorized access to systems or accounts

  • copy or reproduce website content without permission

  • violate any applicable laws or regulations

We reserve the right to suspend or terminate access for violations of these Terms.


9. User Content

Certain features of the Service may allow you to upload or submit content, including:

  • property photos

  • system documentation

  • service reviews

  • comments or communications

By submitting content, you grant Solariq360 a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content for purposes of operating and improving the Service.

You represent that you have the right to submit any content you provide.

Solariq360 reserves the right to remove content that violates these Terms.


10. Modifications to the Service

Solariq360 may modify, suspend, or discontinue any portion of the Service at any time without prior notice.

We are not liable for any modification or interruption of the Service.


11. Intellectual Property

All content available through the Service, including:

  • text

  • graphics

  • logos

  • software

  • design

  • reports

  • inspection materials

is the property of Solariq360 or its licensors and is protected by intellectual property laws.

You may not reproduce or distribute this content without written permission.


12. Third-Party Links

The Service may contain links to third-party websites or services.

Solariq360 does not control and is not responsible for the content, accuracy, or policies of these third-party sites.

Your use of third-party websites is at your own risk.


13. Privacy

Your use of the Service is also governed by the Solariq360 Privacy Policy, which describes how we collect and use personal information.


14. Indemnification

You agree to defend, indemnify, and hold harmless Solariq360 and its officers, employees, contractors, and partners from any claims, damages, liabilities, and expenses arising from:

  • your use of the Service

  • your violation of these Terms

  • your violation of any applicable law

  • your infringement of any third-party rights


15. Disclaimer of Warranties

The Service and all content are provided “as is” and “as available.”

Solariq360 makes no warranties, express or implied, including:

  • merchantability

  • fitness for a particular purpose

  • accuracy or completeness of information

  • uninterrupted service availability

Information provided through the Service may be outdated or incomplete.

Use of the Service is at your own risk.


16. Limitation of Liability

To the fullest extent permitted by law, Solariq360 shall not be liable for any:

  • indirect damages

  • incidental damages

  • consequential damages

  • loss of profits

  • loss of data

  • loss of business opportunity

arising from use of the Service.

Total liability for any claim related to the Service shall not exceed $100 USD.


17. Electronic Communications

By using the Service, you consent to receive communications from Solariq360 electronically, including:

  • service notifications

  • invoices

  • updates

  • marketing communications

Electronic communications satisfy any legal requirement that such communications be in writing.

SMS Terms of Service

By opting into SMS from a web form or other medium, you are agreeing to receive SMS messages from SolarIQ360. This includes SMS messages for conversations (external). Message frequency varies. Message and data rates may apply. See privacy policy at https://solariq360.com/privacy-policy/. Message HELP for help. Reply STOP to any message to opt out.


18. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.


19. Dispute Resolution & Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA).

Arbitration will take place in California.

You and Solariq360 agree that:

  • arbitration will occur on an individual basis

  • class actions are not permitted

  • both parties waive the right to a jury trial

The arbitrator’s decision will be final and binding.

Nothing in this section prevents either party from seeking temporary injunctive relief in a court of competent jurisdiction.
